Purpose

The individual contract signed with the parent or guardian continues to set out the plan, the fee, the duration and the individual terms.

1Acceptance and scope

By using the website www.wonderkids.al, the official app or the digital services of Wonder Kids Academy, the user confirms that they have read and understood these terms and, where required, agrees to them.

A parent or guardian who submits data about a child confirms that they have the legal authority to do so and that the information provided is accurate, complete and up to date.

These terms do not replace the individual service contract. Any specific term negotiated and signed in the individual contract takes precedence over a general provision of these terms, unless mandatory law provides otherwise.

2Application for registration and admission

The online application is a request for review and does not in itself constitute admission of the child, final reservation of a place or the conclusion of a contract.

Wonder Kids Academy may request additional documentation that is necessary for registration, safety, care, licensing or compliance with legal obligations.

Admission takes place after review, confirmation of the place and completion of the required documentation or contract. The Academy does not guarantee an available place merely because an application has been submitted.

3Services, schedule and plans

The services may include early childhood education and care, meals, educational activities, reporting through the app, planned activities and additional services included in the chosen plan.

The general schedule, the drop-off hours, additional services and the content of the plans are published on the official website or set out in the individual contract. Additional services are provided only when they have been booked, are included in the plan or have been confirmed by the Academy.

Wonder Kids Academy may make organisational changes that do not affect the essence of the service, safety or the rights of the parent and the child. Material changes to the service, schedule or price are handled in accordance with section 7 of these terms.

4Drop-off, pick-up and authorised persons

The child may be handed over only to authorised staff and may be picked up only by the parent, the guardian or another person authorised in advance.

Wonder Kids Academy may ask for reasonable identification before handing over the child. If there is uncertainty, a conflict between guardians, a court order, a risk to the child or a reasonable doubt about the authorisation, the Academy may delay handing over the child until the authorised person has been verified or the competent authorities have been contacted.

The parent or guardian must notify the Academy immediately of any change in the authorised persons, the emergency contacts or the legal restrictions concerning the pick-up of the child.

5Safety and supervision of children

The best interests, safety, dignity and well-being of the child take priority in the application of these terms.

Children are supervised in accordance with internal procedures and must not be left without proper supervision in classrooms, the yard, sleeping areas, corridors or other care areas.

The Academy may restrict or prohibit bringing items that pose a risk to children, including jewellery, toys or unsuitable objects. For personal items brought in breach of the rules, the Academy’s liability is limited only to the extent permitted by law, and this does not exclude mandatory liability for an act or omission of the Academy.

6Health, allergies and emergencies

The parent or guardian must provide accurate and up-to-date information about allergies, health conditions, special needs, emergency contacts and any other information that is essential for the safe care of the child.

The parent or guardian may be asked to pick up a child who has symptoms that may endanger the child’s own health or the health of other children, in accordance with a reasonable assessment, the Academy’s procedures and the requirements of the health authorities.

Wonder Kids Academy does not routinely administer medication. If a medical need requires a specific protocol, including emergency medication, this is handled only by separate written agreement, with professional guidance where required, and in accordance with the law.

In an emergency, the Academy may give first aid, contact the parent or guardian and, where necessary, seek urgent medical help. The parent authorises the taking of reasonable measures necessary to protect the child’s life and health, without limiting the legal requirements for medical consent.

7Fees, payments and price changes

The fee, the plan, and the method and deadline of payment are set out in the individual contract, an invoice, an offer or a confirmation accepted by the parent or guardian.

The child’s absences do not automatically give rise to a right to a refund of the fee, because the place, the staff and the organisational capacity are reserved for the contract period, unless the individual contract or the law provides otherwise.

Any rule on keeping the place during a planned absence, including a possible fee of 50 per cent, applies only if it has been set out clearly and without contradiction in the individual contract or in a separate agreement with the parent.

The Academy does not retroactively change the price of a period that has already been paid. If, for objective and documentable reasons, a change to the fee is needed for future periods, the parent is notified in writing at least 30 days in advance and, where the change is material, is given the opportunity to end the relationship before the new fee takes effect, without a penalty for the price change itself.

In the event of late payment, the Academy may send a notice, limit non-essential services or, where permitted by the contract and the law, suspend or terminate the service after a reasonable deadline and the relevant notice. No measure is applied in a way that endangers the child’s safety.

8Absences and termination by the parent

The parent or guardian must report absences in the manner set by the Academy, including through the app when this feature is available.

Regular termination of the service requires written notice at least 30 days in advance, unless the individual contract or the law gives the parent a more favourable right.

The parent remains responsible for the obligations incurred up to the effective date of termination. Wonder Kids Academy does not apply disproportionate compensation or penalties for termination of the contract. Any payment connected with termination must be clearly provided for, reasonable and in accordance with consumer protection legislation.

9Suspension or termination by Wonder Kids Academy

The Academy may suspend or terminate the relationship where there is a material breach of the contract, non-payment after notice and a deadline to remedy it, a serious risk to safety, threatening behaviour towards children or staff, misuse of the system, false documentation or another reason permitted by law.

Where circumstances allow, the parent is notified in advance and given a reasonable opportunity to remedy the situation. In the event of an immediate risk to a child, a person or an information system, the Academy may take immediate proportionate measures.

If the Academy terminates the service through no fault of the parent and a paid service is not provided, the amounts paid are dealt with in accordance with the contract and mandatory consumer rights.

10Use of the app and account security

Parent or guardian accounts are created or activated by the Academy and are personal. Login credentials must not be shared with unauthorised persons.

The user must notify the Academy immediately if they suspect that their account, password or device has been compromised.

The Academy may log technical data and security events, restrict suspicious sessions, require a password reset and temporarily suspend access when this is necessary for the security of children, users or the system.

It is prohibited to attempt to access other accounts, circumvent security controls, extract data automatically, interfere with the code or infrastructure, manipulate reports, delete data without authorisation or make any unlawful use.

11Photographs, videos and materials in the app

Photographs or videos of activities that are shared within the app are used for communication and documentation of the service, in accordance with the Privacy Policy and the Academy’s access controls.

The parent or guardian must not publish, distribute or reuse, on social media, in public groups or with third parties, any material that identifies other children without the proper consent of their parents or guardians.

Photographs or videos for the public website, advertising or social media of Wonder Kids Academy are used only on the basis of separate, clear and revocable consent, where consent is the legal basis. Refusing consent for marketing must not be a condition for receiving the basic service.

12Communication with staff

Communication about matters concerning the child must take place through the Academy’s official channels. Teachers may not respond immediately while they are busy supervising the children and running their activities.

For urgent matters, the official contact number or the emergency channel designated by the Academy must be used.

Communications may be kept as part of the record of the service, safety, the handling of requests or the protection of legal interests, in accordance with the Privacy Policy.

13Camera surveillance

Wonder Kids Academy may use camera surveillance only for lawful and proportionate purposes relating to the safety of children, persons and property, in accordance with the legislation on personal data protection.

Cameras are not placed in toilets, changing areas or places where there is a high expectation of privacy. Any camera in indoor care areas must be justified by a documented assessment of necessity and proportionality.

The Wonder Kids Academy surveillance system must not record sound. Access to footage is limited to authorised persons, the necessary records are kept and visible notices are put in place.

The full rules on surveillance, retention periods and the rights of individuals are set out in the Privacy Policy and in the specific camera notice.

14Off-site activities and transport

When the Academy organises an activity outside the premises, parents are informed according to the nature of the activity and separate consent is obtained where required. Safety measures are adapted to the age of the children and the activity.

If transport of the child is not provided or organised by Wonder Kids Academy, responsibility for transport remains with the parent or guardian. When transport is organised by the Academy, responsibilities are determined by the relevant agreement and the law.

15Educational content, specialists and the limits of the service

The Academy’s programmes, reports and activities are educational and developmental in nature. Staff observations do not constitute a medical or psychological diagnosis.

When a service is provided by a licensed or qualified professional, that professional acts within their own professional competence and in accordance with legal requirements. If a diagnosis or individual treatment is needed, the parent is advised to consult the relevant professional.

16Intellectual property

The Wonder Kids Academy name, logo, original materials, design, educational content, text, graphics and elements of the app are protected by law and may not be copied, sold, republished or used commercially without authorisation.

This provision does not limit the legal rights of the parent over their own personal data or those of the child, nor the rights of the data subject under the law.

17Maintenance and digital availability

The Academy aims for reasonable availability of the website and the app but does not guarantee uninterrupted operation. Maintenance, updates, network problems or technical incidents may cause temporary interruptions.

In the event of an interruption, processes that are critical to the safety of children must continue using alternative methods set by the Academy, and data must be restored or synchronised when this is safe and possible.

18Limitation of liability

Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for intentional acts, negligence where the law imposes it, personal injury, violation of the rights of the child, breach of data protection obligations or of mandatory consumer rights.

To the extent permitted by law, Wonder Kids Academy is not liable for indirect losses that were not a foreseeable consequence of a breach by the Academy, for the loss of personal items brought in breach of the rules, or for actions beyond the Academy’s reasonable control.

Children’s normal activity involves ordinary minor risks despite reasonable care. This does not reduce the Academy’s obligation to provide supervision, safety and professional care.

19Force majeure and temporary closures

The Academy may temporarily suspend its activity when this is required by the authorities or caused by events beyond its reasonable control, such as natural disasters, a serious health risk, infrastructure outages, fire, civil unrest or another extraordinary situation.

The Academy notifies parents as soon as is practically possible. The financial consequences of a closure are dealt with according to the individual contract, the nature and duration of the event and mandatory consumer rights.

20Complaints and dispute resolution

Parents may submit a complaint or request in writing to info@wonderkids.al or to the Academy’s address. The Academy records and handles the request without undue delay and within the legal deadlines.

The parties are encouraged to first seek a reasonable solution through direct communication. This does not limit the right of the consumer, the data subject or the parent to turn to the competent authority or the court.

For privacy matters, the person may also contact the Information and Privacy Agency.

21Changes to these terms

The Academy may update these terms for legal, security, technical or organisational reasons. Changes that materially affect the rights or obligations of the parent are notified reasonably in advance.

A change to these terms cannot be used to retroactively change a financial obligation or an individual term of the contract without a legal basis or without the required consent.

The version and the date of entry into force are published on the official website.

22Applicable law and final provisions

These terms are interpreted in accordance with the laws of the Republic of Kosovo. The competent court is determined according to the applicable law, and no provision is intended to deprive the consumer of a forum or a right guaranteed by law.

If a provision is declared invalid or unenforceable, the remainder of the terms remains in force to the extent permitted by law.

A failure by the Academy to exercise a right immediately is not considered a waiver of that right.
